Why this page exists

Shroomsy is an educational service and a grow kit shop selling kits containing Psilocybe cubensis mycelium. Our goal is to provide reliable, science-based information about psilocybin mushrooms in the spirit of harm reduction.

The legal status of psilocybin mushrooms, grow kits, spores, and mycelium varies dramatically by country, region, and sometimes even city, and it changes over time. What is legal today may not be legal tomorrow, and vice versa.

We are not a law firm and cannot track legislative changes in every jurisdiction. That is why this page focuses on Polish law, since Poland is our home jurisdiction and the jurisdiction under which our sales take place, together with pointers on what to check. Legal status under Polish law

Poland is our home jurisdiction and the jurisdiction under which our sales take place. Key distinctions under Polish law:

Mycelium

Not a controlled substance. Possessing a grow kit containing mycelium is legal under Polish law.

Spores

Contain no psilocybin or psilocin. Possession is not penalised under Polish law.

Fruiting bodies

Contain psilocybin, a controlled psychotropic substance under the Polish Act on Counteracting Drug Addiction. Possession is illegal under Polish law.

Cultivation to obtain fruiting bodies

Treated as manufacturing a psychotropic substance under Polish law. Illegal.

Jurisdiction and place of sale

All orders placed through our store are processed and settled in Poland, regardless of the buyer's country of residence. This means the sale is carried out under Polish law, and Polish law governs the sales contract.

We operate fully legally and issue sales documents in accordance with applicable Polish tax rules.

Your responsibility as a customer

We deliberately do not publish a legal map or a country-by-country status table for grow kits, spores, or psilocybin mushrooms. Legislation changes faster than we could keep such content updated, the distinction between possession, cultivation, consumption, sale, and transport differs by jurisdiction, and quantity thresholds, definitions of "personal use", and penalties can differ even within a single country.
